The Supreme Court on Thursday ordered a final hearing on December 10 in the matter of abolition of special status of Jammu and Kashmir. Justice NV Ramanna said, “The central government should file an affidavit by November 22 to present its side in this case.” The court directed the lawyers related to the case to collect all the facts and documents, as well as finalize the date of hearing.
The constitution bench of 5 judges was hearing the petitions filed against the decision to remove Article 370 from Kashmir. The court also heard the petition of Anuradha Bhasin in the Kashmir sanctions case. Bhasin’s lawyer Kapil Sibal said in court, “You cannot ban the entire community from fundamental rights granted to them under Article 19”. Cross-border terrorism has already existed. The people of Kashmir are peace loving.
Sibal said- it is difficult to reach the hospital in Kashmir
During the debate on the issue of shutting down the communication services in the state, Kapil Sibal said – Stop those who make your work difficult, but the rights of peace-loving people should be protected. He said- It may be right to ban social media, but it will not be right that you stop the entire Internet. Landline is necessary for telephone communication. Telephone cannot affect law and order. How can you stop me from talking to anyone? If the telephone is not present and if a medical emergency comes, how can I reach the hospital?
On August 5, Article 370 was removed from Jammu and Kashmir.
On August 5, the central government abolished Article 370 giving special status to Jammu and Kashmir. Simultaneously, Jammu and Kashmir and Ladakh were made two separate union territories. After this, telephone, mobile and internet services were discontinued throughout the state.
